This Month's Minutes PAGE 2011-13 MINUTES OF THE REGULAR MEETING OF THE ALLAMUCHY TOWNSHIP COUNCIL HELD APRIL 20, 2011 AT 7:00 P.M. 1. The meeting was called to order at 7:00 P.M. by Mayor Cote. 2. Mayor Cote advised that this meeting was held in accordance with the Open Public Meetings Act as prescribed by State Statute which was followed by the Pledge of Allegiance. 3. Present: Mayor Cote, Councilman Ochwat, Councilwoman Schultheis, Councilman Sloane and Councilman Young. 4. APPROVAL OF MINUTES: a. Regular Meeting March 15, 2011 as corrected: Page 2011-12 - 4. Last sentence - correct to read Councilwoman Schultheis. Motion by Councilwoman Schultheis, seconded by Councilman Sloane, and approved on roll call vote: AYES Councilpersons Sloane, Schulteis, Ochwat, Young and Mayor Cote. 5. INTRODUCTION OF THE 2011 MUNICIPAL BUDGET (ATTACHMENT 1). Motion by Councilwoman Schultheis, seconded by Councilman Sloane, carried to introduce the 2011 Municipal Budget as presented. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. The public hearing and final adoption of the 2011 Municipal Budget is scheduled for May 24, 2011. Motion by Councilwoman Schultheis, seconded by Councilman Ochwat, carried to approve the Half Marathon Event to be held October 9, 2011. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. PAGE 2011-14 6. APPROVAL OF ENGINEERS REPORT/ACTION LIST: a. Michael/Peter Drive Sidewalk Improvement Project - Award contract to Anviro Contractors in the amount of $3,539.50. Motion by Councilman Sloane, seconded by Councilwoman Schultheis, and approved on roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. Councilman Sloane stated that a meeting was held regarding the water main replacement project. An announcement will be placed on the website and the engineer will be the point of contact for this project. The project is scheduled to begin May 2, 2011. 7. ATTORNEYS REPORT: a. Attorney Wacks advised that he had prepared a resolution approving the place-to- place and person to person transfer for Mark Skoda. This resolution should be adopted at this meeting. b. The revised Cash for Crash Ordinance was circulated to the Township Council. Attorney Wacks advised that he has removed from the ordinance the words "Rescue Squad Services" as requested by the Allamuchy-Green First Aid Squad. c. Attorney Wacks advised that a letter was sent to Mr. Lopate, 1 Oakcrest Drive, by the Zoning Officer. Mr. Lopate has twenty days to file an application with the Land Use Board otherwise a zoning violation will be signed by the Zoning Officer. d. Attorney Wacks stated that he has contacted the Department of Community Affairs regarding Section 8 tenants and he is waiting for a response back. 8. Councilman Ochwat stated that the Township Council will be voting on the Special Municipal Services District Budget. There is a budget for Village IX but the Township Council does not yet have a copy. This is also the same situation for The Crest budget. Councilman Sloane suggested that the SMSD Budget be approved contingent upon the receipt of the other two district budgets. PAGE 2011-15 Attorney Wacks stated that The Crest budget will be the same as last year but Village IX opted into the SMSD this year. There has not been a budget in the past for this Village. Councilman Young believed there was a provision in the ordinance that if The Crest does not submit a budget then the previous years budget figures will be used. Attorney Wacks advised that was correct. If The Crest budget is not received then last years figures will be used. Councilman Young advised that sponsorship letters were sent to businesses for the Harvest Festival. Mr. Young stated that he will keep the Council updated on responses. 9. Guy Howie, Main Street, Allamuchy, N.J. was present and stated that the Shell Station in the Village is operating 24 hours per day. He stated that he was concerned with the safety aspect if these hours were permitted. The Municipal Clerk advised that a copy of the ordinance was mailed to the owners of the gas station and a copy will also be hand-delivered to them. The ordinance has not changed and the businesses are to be closed from 12:00 a.m. - 5:00 a.m. 10. ORDINANCES FIRST READING: a. # 2011-05 "ORDINANCE AUTHORIZING AN EMERGENCY APPROPRIATION OF $200,000 PURSUANT TO N.J.S.A. 40A:4-53 FOR THE PREPARATION AND EXECUTION OF A COMPLETE PROGRAM OF REVALUATION OF REAL PROPERTY FOR THE USE OF THE TOWNSHIP TAX ASSESSOR D IN AND BY THE TOWNSHIP OF ALLAMUCHY, IN THE COUNTY OF WARREN, NEW JERSEY." Motion by Councilman Sloane, seconded by Councilwoman Ochwat, carried to introduce Ordinance # 2011-05 on first reading. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. Second reading to take place on May 24, 2011. PAGE 2011-16 11. ORDINANCES SECOND READING: a. # 2011-02 - BOND ORDINANCE APPROPRIATING $300,000 AND AUTHORIZING THE ISSUANCE OF $285,000 OF BONDS AND/OR BOND ANTICIPATION NOTES FOR THE PURPOSE OF IMPROVEMENTS TO SHADES OF DEATH ROAD AUTHORIZED TO BE UNDERTAKEN IN AND BY THE TOWNSHIP OF ALLAMUCHY, IN THE COUNTY OF WARREN, NEW JERSEY. At this time, the meeting was opened to the public and the public hearing was held on Ordinance # 2011- 02. There were no comments from the public and the public hearing was closed. Motion by Councilman Sloane, seconded by Councilman Young, carried to carry the adoption of Ordinance # 2011-02 to May 24, 2011 as the Supplemental Debt Statement has not been returned from the State of New Jersey, Division of Local Government Services. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. b. # 2011-03 - "ORDINANCE PROVIDING FOR THE ADMINISTRATIVE ASSESSMENT AND COLLECTION OF FEES AND COSTS INCURRED IN CONNECTION WITH FIRE DEPARTMENT SERVICES ." At this time, the meeting was opened to the public and the public hearing was held on Ordinance # 2011-03. There were no comments or objections and the public hearing was closed. Motion by Councilman Sloane, seconded by Councilwoman Schultheis, carried to adopt Ordinance # 2011-03 on second reading. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. c. # 2011-04 AN ORDINANCE TO AMEND ORDINANCE 2010-13 ENTITLED "AN ORDINANCE TO AMEND IN ITS ENTIRETY ORDINANCE 2007-03 OF THE CODE OF ORDINANCES OF THE TOWNSHIP OF ALLAMUCHY AN ORDINANCE PURSUANT TO ORDER OF THE SUPERIOR COURT OF NEW JERSEY CREATING SPECIAL MUNICIPAL SERVICES DISTRICTS. Motion by Councilman Ochwat, seconded by Councilwoman Schultheis, carried to adopt Ordinance # 2011-04 on second reading. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. 12. RESOLUTIONS: a. "BE IT RESOLVED, by the Township Council of the Township of Allamuchy, County of Warren, State of New Jersey that the following homestead rebate refunds are hereby approved: Block 718 Lot 13 - $489.39 and Block 718 Lot 160 - $208.29." b. Authorize Expenditure of $3,000.00 to Playground Committee (to be used for mailings, donation requests, and printing expenses). c. Shades of Death Road Improvements - Utilization of the Morris County Cooperative Pricing Council (ATTACHMENT 2). Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. d. Approval of the SMSD Budget (ATTACHMENT 3). Motion by Councilwoman Schultheis, seconded by Councilman Ochwat, carried to adopt the SMSD Budget as presented. If The Village of Old Farm (Village IX) budget is not received by May 10, 2011 then that Villages budget will not be considered received. If a budget is received then the Township Council will reserve the right to review the budget. If The Crest does not submit a budget then the budget from last year will be used. The Village of Old Farm budget must also be approved by PVPOA. Roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. PAGE 2011-18 e. Approval of Liquor License Transfer - Person-to-Person and Place-to-Place (ATTACHMENT 4). Motion by Councilwoman Schultheis, seconded by Councilman Young, and approved on roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. The Municipal Clerk advised that there were no objections either written or by mail to this transfer application. 13. OTHER/NEW BUSINESS: a. Appointment to the Land Use Board Clara Bajc, Class IV, to fill the unexpired term of Robert J. Resker. Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. b. Approval of Raffle Applications Allamuchy Education Foundation Event to be held May 16, 2011 - "Golf Outing." Motion by Councilman Sloane, seconded by Councilwoman Schultheis, and approved on roll call vote: AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote. c. Mayor Cote stated that the Fire Department would like to transfer their vehicles to the Township. A Vehicle Use Policy needs to be in place before the Township can accept these vehicles. This matter will be placed on the May 24, 2011 Township Council agenda. d. Mayor Cote advised that he has been working with Mattar to purchase tables and chairs for the fire house. There are 190 chairs and 18 tables needed. Mayor Cote advised that the tables and chairs will hopefully be purchased through either a State Contract or the Morris County Cooperative Pricing Council. The bar could be purchased directly since it costs under $2,000.00. Motion by Councilman Young, seconded by Councilman Ochwat, carried to authorize Mayor Cote to handle the purchase of the table and chairs administratively as long as the entire purchase price does not exceed $17,500.00. Proclamation declaring May as Older Americans Month Motion by Councilwoman Schultheis, seconded by Councilman Sloane, carried to concur with Mayor Cotes Proclamation declaring May as Older Americans Month.
