MINUTES OF THE REGULAR MEETING OF THE ALLAMUCHY TOWNSHIP COUNCIL
HELD FEBRUARY 21, 2012 AT 7:00 P.M.
 
 
1.   The meeting was called to order at 7:05 P.M. by Mayor Schultheis.
 
2.   Mayor Schultheis advised that this meeting was held in accordance with the Open Public
      Meetings Act as prescribed by State Statute which was followed by the Pledge of Allegiance.
 
3.   Present: Mayor Schultheis, Councilwoman Cook, Councilman Sloane and Councilman
      Young; Absent - Councilman Ochwat.
 
4.   APPROVAL OF MINUTES:
 
      a. Reorganization Meeting - January 3, 2012 as presented.
 
           Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
           call vote: AYES - Councilpersons Sloane, Young and Mayor Schultheis; ABSENT -
           Councilman Ochwat and Councilwoman Cook.
 
      b. Special Meeting - January 11, 2012 as presented.
           
           Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
           call vote: AYES - Councilpersons Sloane, Young and Mayor Schultheis; ABSENT -
           Councilman Ochwat and Councilwoman Cook.
 
      c. Regular Meeting - January 18, 2012 as submitted.
          
           Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
           call vote: AYES - Councilpersons Sloane, Young and Mayor Schultheis; ABSENT -
           Councilman Ochwat and Councilwoman Cook.
 
5. Mayor Schultheis advised that the gas pressure at the Fire House is being addressed and
     hopefully will be corrected soon. The architect and the engineers are working together
     to get this problem resolved. 
 
6. ENGINEERS REPORT:
 
     a. Dallarda Drive Detention Basin Plate with a 3 opening approval of quote Modern         
          Concrete - $234.00.
 
     b. Bountiful Drive Drainage Improvements A letter granting easements must be received
          by the Township no later than March 14, 2012 from Mr. Davies and Mr. Meyers.
 
     Motion by Councilman Young, seconded by Councilman Sloane, and approved on roll call
     vote: AYES Councilpersons Sloane, Young and Mayor Schultheis; ABSENT

7. ATTORNEY'S REPORT:
 
     a. Attorney Wacks stated that he had prepared a resolution to accept a detention and drainage
          easement agreement from John Abromitis and Eileen Coen (Husband and Wife) with
          regard to the Bountiful Drive Drainage Improvement Project.
    
     Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
     call vote: AYES - Councilpersons Sloane, Young and Mayor Schultheis; ABSENT -
     Councilman Ochwat and Councilwoman Cook.
                
     b. Attorney Wacks advised that he had reviewed and revised the Remax Property
          Maintenance Agreement. All expenditures will need to be approved by the Township.
 
     c. Attorney Wacks stated that the bid specifications for garbage and recycling have been
          finalized and changes were made in accordance with the Township Council
          recommendations.
 
     d. Attorney Wacks advised that Attorney Beilin is reviewing the Rutherfurd Hall Grant             
          agreement and a report will be made at the March meeting..
 
8. At this time, Mayor Schultheis issued the Oath of Office to Fire Chief Kevin Flanagan.
 
9. PUBLIC SESSION
 
     There were no comments from the public and the public session was closed.
 
       10. ORDINANCES - FIRST READING:
 
     a. # 2012-02 BOND ORDINANCE APPROPRIATING $250,000 AND    
                                AUTHORIZING THE ISSUANCE OF $237,500 OF BONDS AND/OR  
                                BOND ANTICIPATION NOTES FOR THE PURPOSE OF  
                                IMPROVEMENTS TO SHADES OF DEATH ROAD, PHASE II,  
                                AUTHORIZED TO BE UNDERTAKEN IN AND BY THE
                                TOWNSHIP OF ALLAMUCHY, IN THE COUNTY OF WARREN,
                                NEW JERSEY.
 
              Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
              call vote: AYES - Councilpersons Sloane, Young, and Mayor Schultheis; ABSENT -
              Councilman Ochwat and Councilwoman Cook.
 
       11. ORDINANCES - SECOND READING:
 
     a. # 2012-01 BOND ORDINANCE AUTHORIZING THE APPROPRIATION OF A
                                 SUM NOT TO EXCEED $3,115,000 AND AUTHORIZING THE
                                 ISSUANCE OF REFUNDING BONDS AND/OR NOTES OF THE
                                 TOWNSHIP OF ALLAMUCHY, IN THE PRINCIPAL AMOUNT
                                 NOT TO EXCEED $3,115,000, TO REFUND, IN FULL OR IN PART,
                                 THE OUTSTANDING BALANCE OF GENERAL IMPROVEMENT
                                 BONDS, SERIES 2004A OF THE TOWNSHIP TO REDEEM IN
                                 FULL OR IN PART SUCH OUTSTANDING BALANCE AND TO
 
 
 
                                                                                                                         PAGE 2012-12
 
 
 
                                  FINANCE THE COSTS OF ISSUANCE OF SUCH REFUNDING
                                  BONDS ON BEHALF OF THE TOWNSHIP AND TO PROVIDE  
                                  FOR THE ISSUANCE OF SUCH REFUNDING BONDS.
 
              The Municipal Clerk advised that the Local Finance Board has not approved the documents
              submitted by the Bond Counsel and the public hearing be carried to the March 20, 2012
              Township Council meeting.
 
              Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
              call vote: AYES - Councilpersons Sloane, Young and Mayor Schultheis; ABSENT -
              Councilman Ochwat and Councilwoman Cook.
 
       12. RESOLUTIONS:
              
              a. BE IT RESOLVED, by the Township Council of the Township of Allamuchy, County
                   of Warren, State of New Jersey, that the following tax refund is hereby approved:
                   Block 718 Lot 40 - $1,355.00.
              b. BE IT RESOLVED, by the Township Council of the Township of Allamuchy, County
                   of Warren, State of New Jersey, that the following Homestead Rebate is hereby refunded:
                   Block 708 Lot 13 - $978.79.
              c. Approval of Blue Light Permits Anita Hahn (Allamuchy-Green First Aid Squad),
                   Michael Consalazio (ATVFD), Philip Garcia (ATVFD), David Berkenbush (ATVFD),
                   Barbara Morgan (Allamuchy-Green First Aid Squad), Annette Toomey (Allamuchy-Green
                   First Aid Squad).
              d. Approval of New Fireman Application Sean ORourke, Rainier Court, Allamuchy,
                   N.J.
              e. Resolution to accept the Detention Drainage Easement Bountiful Drive Improvement
                   Project and authorize the Mayor and Municipal Clerk to execute the same
                   (ATTACHMENT 1).   
                               
              Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
              call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis; ABSENT
              Councilman Ochwat and Councilwoman Cook.
 
       13. OTHER/NEW BUSINESS:
 
              a. Appointments to the Musconetcong River Management Council Charles Fineran and
                   Royal Nadeau (Alternate).
 
                   Motion by Councilman Young, seconded by Councilman Sloane, and approved on roll
                   call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis; ABSENT
                   Councilman Ochwat and Councilwoman Cook.
 
              b. Authorize the Municipal Clerk to advertise the Solid Waste and Recycling Bid.
                  
                   Motion by Councilman Young, seconded by Councilman Sloane, and approved on roll
                   call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis; ABSENT

              c. Remax Property Maintenance Agreement (Village of Old Farm) Authorize the Mayor
                   and Clerk to execute the agreement as presented by Attorney Wacks.
 
                   Motion by Councilman Young, seconded by Councilman Sloane, and approved on
                   roll call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis;
                   ABSENT Councilman Ochwat and Councilwoman Cook.
 
              d. Authorize the Mayor and Municipal Clerk to execute the Highlands Contract Grant 
                   Agreement Amendment.
 
                   Motion by Councilman Sloane, seconded by Councilman Young, and approved on
                   roll call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis;
                   ABSENT Councilman Ochwat and Councilwoman Cook.
 
        14. APPROVAL OF BILL LIST AND ADD-ON LIST AS PRESENTED
               (ATTACHMENT 2).
 
               Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
               call vote: AYES Councilpersons Sloane, Young and Mayor Schultheis; ABSENT
               Councilman Ochwat and Councilwoman Cook.
