MINUTES OF THE REGULAR MEETING OF THE ALLAMUCHY TOWNSHIP COUNCIL HELD JULY 19, 2011 AT 7:00 P.M.


1.   The meeting was called to order at 7:00 P.M. by Mayor Cote.

2.   Mayor Cote advised that this meeting was held in accordance with the Open Public Meetings
      Act as prescribed by State Statute which was followed by the Pledge of Allegiance.

3.   Present:  Mayor Cote, Councilman Ochwat, Councilwoman Schultheis, Councilman Sloane
      and Councilman Young.

4.   APPROVAL OF MINUTES:

      a.  Regular Meeting - June 21, 2011 as submitted.

           Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on roll
           call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;  ABSTAIN -
           Councilwoman Schultheis.

5.   MAYORS' REPORT:

      a.   Mayor Cote advised that he had met with representatives from Gem Solar, Dr.
            Frederiks and Attorney Wacks regarding the proposed solar project.

            Attorney Wacks stated that an appraisal of the property should be done and that the
            Township acquire the property.  A determination would need to be made as to the useful
            life of the solar equipment and that figure would be divided into the appraised value. 
            This figure would be the set amount the school board would receive every year. 

            Attorney Wacks advised that the Township would retain the revenue.  This revenue
            would be used to offset municipal taxes.

6.   APPROVAL OF ENGINEER'S REPORT/ACTION LIST:
  
        a.   Authorize Partial Payment No. 2 to P.M. Construction in the amount of $238,473.87  
              (Water Main Replacement Project);  (Check to be released upon approval of Twp.
              Engineer).
        b.   Shades of Death Road Improvement Project Authorize payment to Key-Tech in
              the amount of $3,500.00;
        c.   Shades of Death Road Improvement Project Authorize payment to M.L. Ruberton
              (Guiderail End Treatments) in the amount of $6,388.00;
        d.   Shades of Death Road Improvement Project Approve Payment to Tilcon New York,
              Inc. in the amount of $237,647.76 (Check to be released upon approval of Township
              Engineer).
                     
            Motion by Councilman Sloane, seconded by Councilwoman Schultheis, and approved
            on roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young, Schultheis and Mayor
            Cote.

7.   ATTORNEY'S REPORT:

      a.   Attorney Wacks advised that a letter was received from the Warren County Housing
            Program advising the Township that the Housing Program will be submitting an
            application to the New Jersey Department of Community Affairs.  The application will
            be for a small cities grant to provide rehabilitation assistance for low and moderate
            income households to address needed dwelling repairs.

            Attorney Wacks suggested that the Township Council authorize the Mayor to sign
            a letter supporting the application by Warren County.  This may help the Township
            obtain grant funding for housing in need of repair.  The grant money would be available
            and it would give the municipality an opportunity to rehabilitate dwellings.  There is
            no financial commitment by the Township.

           Motion by Councilwoman Schultheis, seconded by Councilman Sloane, carried to
           authorize Mayor Cote to sign the letter of support to the filing of a grant application by
           the Warren County Housing Program for a small cities grant.  Roll call vote:  AYES
           Councilpersons Sloane, Ochwat, Schultheis, Young and Mayor Cote.

      b.  Attorney Wacks advised that he had prepared two resolutions for consideration by
           the Township Council.  The first resolution addresses the concern and need for a traffic
           light at the County Route 517/Route 80 ramp.  The other resolution addresses the Fire
           Departments request for a grant to purchase playground equipment to be used in the
           Allamuchy Playground.
        
8.   COUNCIL/COMMITTEE REPORTS:

      a.  Councilman Ochwat reported that he has was not aware of any further action regarding
           the Certificate of Occupancy for the Mountain Villa School.  There were drafts of a letter
           circulated with conditions that needed to be met but to his knowledge the letter has not
           been approved by representatives of the school or sent to the state by the schools
           architect.  The Mountain Villa School is still operating under a temporary Certificate of
           Occupancy and it is uncertain as to when a final Certificate of Occupancy will be granted.

       b.  Councilman Young stated that he would like to report that normal maintenance is
            occurring on the roads.  The spray program has started along with roadside mowing.
            The DPW is conducting additional grading and shoulder work at the lower end of
            Catswamp Road.  A tree trimmer will be brought in to trim low hanging trees in
            preparation for the winter. 

            Councilman Young advised that the fence at the recreation field has been repaired and
            quotes are being obtained for the application of additional clay on the ball fields. 
            It was recommended that money be appropriated in the 2012 municipal budget for
            repairs to the tennis courts and basketball courts.

       c.  Councilwoman Schultheis stated that she wanted to mention that the Rutherfurd Hall
            Grant Application hearing will be held August 1, 2011 by the Warren County Municipal
            and Charitable Conservancy Trust Fund Committee.

 9.   Attorney Wacks advised that a letter was received from the Warren County Engineers
       Office regarding engine braking.  The letter advises that the State of New Jersey Department
       of Transportation does not approve of the prohibition of engine braking.  He advised that he
       will do some more research on this matter and report back to the Township Council at the
       August meeting.   

     10.   PUBLIC SESSION

       There were no comments from the public and the public session was closed.

    11.   ORDINANCES - SECOND READING AND PUBLIC HEARING:

            a.  # 2011-07 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER
                                       XV, "AFFORDABLE HOUSING ORDINANCE", OF THE CODE OF
                                       THE TOWNSHIP OF ALLAMUCHY, COUNTY OF WARREN,
                                       STATE OF NEW JERSEY, TO SATISFY THE REQUIREMENTS
                                       OF THE NEW JERSEY COUNCIL ON AFFORDABLE HOUSING
                                       (COAH) BY SPECIFICALLY AMENDING SECTION 15-115,
                                       ENTITLED "DEVELOPMENT FEES.

                 Motion by Councilman Sloane, seconded by Councilwoman Schultheis, carried to
                 adopt Ordinance # 2011-07 on second reading.

                 At this time, the meeting was opened to the public.
 
                 There were no comments or objections from the public and the public hearing was
                 closed.
        
                 Roll call vote:  AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor
                 Cote.     

            b.  # 2011-08 ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY, COUNTY
                                       OF WARREN, STATE OF NEW JERSEY TO REPLACE CHAPTER
                                       79 ENTITLED "FLOOD DAMAGE PREVENTION" IN ITS
                                       ENTIRETY WITH A NEW CHAPTER 79 ENTITLED "FLOOD
                                       DAMAGE PREVENTION.                   

                 Motion by Councilman Sloane, seconded by Councilwoman Schultheis, carried to
                 adopt Ordinance # 2011-08 on second reading. 

                 At this time, the meeting was opened to the public.

                 There were no comments or objections from the public and the public hearing was
                 closed.

                            PURCHASE OF FIRE DEPARTMENT EQUIPMENT FROM
                            THE GENERAL CAPITAL - CAPITAL IMPROVEMENT
                            FUND.

                Motion by Councilwoman Schultheis, seconded by Councilman Ochwat, carried to
                adopt Ordinance # 2011-09 on second reading.

                At this time, the meeting was opened to the public.

                There were no comments or objections from the public and the public hearing was closed.

                Roll call vote:  AYES Councilpersons Sloane, Schultheis, Ochwat, Young and
                Mayor Cote.

     d.  # 2011-10 AN ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY
                              PROVIDING FOR THE APPROPRIATION OF $10,000 FOR THE
                               PURCHASE OF EQUIPMENT FOR THE STREETS AND ROADS                
                             DEPARTMENT FROM THE GENERAL CAPITAL CAPITAL
                             IMPROVEMENT FUND.
  
                Motion Councilman Young, seconded by Councilwoman Schultheis, carried to adopt
                Ordinance # 2011-10 on second reading.

                At this time, the meeting was opened to the public.

                There were no comments or objections from the public and the public hearing was closed.

                Roll call vote:  AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor
                Cote.        
 
           e.  # 2011-11 AN ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY
                                  PROVIDING FOR THE APPROPRIATION OF $10,000 FOR
                                   IMPROVEMENTS TO ALLAMUCHY TOWNSHIP BUILDINGS
                                  AND GROUNDS FROM THE GENERAL CAPITAL CAPITAL
                                  IMPROVEMENT FUND.

               Motion by Councilman Young, seconded by Councilman Sloane, carried to
               adopt Ordinance # 2011-11 on second reading.

               At this time, the meeting was opened to the public.

               There were no comments or objections and the public hearing was closed.

    12.   RESOLUTIONS:

            a.  2010 Audit Review (ATTACHMENT 1).

                 Motion by Councilman Sloane, seconded by Councilwoman Schultheis, and approved on
                 roll call vote:  AYES - Councilpersons Sloane, Ochwat, Schultheis, Young and Mayor
                 Cote.

            b.  Extension of Tax Quarter (ATTACHMENT 2).
            c.  Allamuchy Land  Development - Authorize the filing of an application to construct a
                 Public Water Facilities (ATTACHMENT 3).
            d.  Allamuchy Land Development - Authorize the Municipal Engineer and the Mayor to
                 endorse  new TWA permits submitted by the Developer (ATTACHMENT 4).
            e.  Route 517/Route 80 Traffic Light (ATTACHMENT 5).
            f.  Grant for Playground Equipment - Fire Department (ATTACHMENT 6).

                Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on roll
                call vote:  AYES Councilpersons Sloane, Schultheis, Ochwat, Young and Mayor Cote.

    13.   APPROVAL OF BILLS AND ADD-ON LIST (ATTACHMENT 7).

             Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll call
             vote:  AYES -  Councilpersons Sloane, Ochwat, Schultheis, Young and Mayor Cote.
