MINUTES OF THE REGULAR MEETING OF THE ALLAMUCHY TOWNSHIP COUNCIL HELD JUNE 21, 2011 AT 7:00 P.M.


1.   The meeting was called to order at 7:00 P.M. by Mayor Cote.

2.   Mayor Cote advised that this meeting was held in accordance with the Open Public Meetings
      Act as prescribed by State Statute which was followed by the Pledge of Allegiance.

3.   Present:  Mayor Cote, Councilman Sloane, Councilman Ochwat and Councilman Young;
      Absent:  Councilwoman Schultheis.

4.   Approval of Minutes:

      a.  Special Meeting - 05/11/2011 as submitted.

      Motion by Councilman Sloane, seconded by Councilman Young, and approved on roll
      call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;
      ABSENT - Councilwoman Schultheis.

      b.   Regular Meeting - 05/24/2011 as submitted.

      Motion by Councilman Young, seconded by Councilman Ochwat, and approved on roll
      call vote:  AYES - Councilpersons Ochwat, Young and Mayor Cote;  ABSTAIN -
      Councilman Sloane; ABSENT - Councilwoman Schultheis.

5.   MAYOR'S REPORT:

      a.  Mayor Cote advised that a letter was received from the Federal Emergency Management
           Agency commending Allamuchy Township for  implementing the floodplain management
           measures for the Township of Allamuchy and participating in the National Flood
           Insurance Program.

      b.  Glass-Steagall Legislation:

           Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to
           authorize the Municipal Clerk to not relist this matter on any future agendas of the
           Township Council.  Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and
           Mayor Cote;  ABSENT - Councilwoman Schultheis.

6.   APPROVAL OF ENGINEER'S REPORT/ACTION LIST:

      a.  Water Main Replacement Project - Phase 2 - Release payment No. 1 to PM Construction
           in the amount of $237,892.84.
      b.  Shades of Death Road Improvements - Approve payment to Denville Line Painting in the
           amount of $5,986.88.
      c.  Bountiful Drive Drainage Improvements - Phase I - Authorize the Municipal Engineer to
           proceed.

      Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to approved the
      Engineer's Report as presented.  Roll call vote:  AYES - Councilpersons Sloane, Ochwat,
      Young and Mayor Cote;  ABSENT - Councilwoman Schultheis.

7.   ATTORNEY'S REPORT

      a.  Attorney Wacks advised that he had received some inquiries from Gem Solar regarding
           the proposed solar project at the Allamuchy Elementary School.  The inquiries included
           questions on the permit process, whether the permit fees would be waived, etc.  A              
           determination needs to be made as to what permits would be needed and whether there are
           any fees that are eligible to be waived.

           Mayor Cote stated that he will discuss this matter with the Construction Official.

      b.  Attorney Wacks advised that he will need an executive session to discuss potential
           litigation.           
      
8.   PUBLIC SESSION:
                         
      a.  Adam Baker, Old Farm Drive, was present and questioned the items located outside
           the Allamuchy General Store on the sidewalk. 

           The Township Council advised that the Zoning Officer is working on this matter
           and addressing the items located outside of the store.

           Councilman Sloane stated that he was concerned that the sidewalk is blocked by
           debris.

           Attorney Wacks advised that the Township Ordinance does address "impediments"
           on sidewalks.

           The Municipal Clerk advised that she will refer this matter to the Zoning Officer. 
           A Notice of Violation will be sent to the General Store outlining the violations that
           exist.

           Councilman Ochwat requested that issue of signage also be addressed.  There are a lot
           of signs for the General Store that are most likely in violation of the Township Sign
           Ordinance. 
 
           The Township Council directed the Municipal Clerk to inform the Zoning Official that
           any violation of Township Ordinances be enforced accordingly.  If the violations are
           not corrected than summonses need to be issued.
           
9.   ORDINANCES - FIRST READING:   
     
      a.  # 2011-07 - AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER XV,
                                 "AFFORDABLE HOUSING ORDINANCE", OF THE CODE OF THE
                                 TOWNSHIP OF ALLAMUCHY, COUNTY OF WARREN, STATE OF NEW
                                 JERSEY, TO SATISFY THE REQUIREMENTS OF THE NEW JERSEY

                                 COUNCIL ON AFFORDABLE HOUSING (COAH) BY SPECIFICALLY
                                 AMENDING SECTION 15-115, ENTITLED "DEVELOPMENT FEES."

      Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to introduce
      Ordinance # 2011-07 on first reading. 
    
      Second reading to take place on July 19, 2011.

      Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote.
      ABSENT - Councilwoman Schultheis.

      b.  # 2011-08 - ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY, COUNTY OF
                               WARREN,  STATE OF NEW JERSEY TO REPLACE CHAPTER 79
                               ENTITLED FLOOD DAMAGE PREVENTION IN ITS ENTIRETY
                               WITH A NEW CHAPTER 79 ENTITLED FLOOD DAMAGE
                               PREVENTION.

      Motion by Councilman Sloane, seconded by Councilman Young, carried to introduce
      Ordinance # 2011-08 on first reading.

      Second reading to take place on July 19, 2011.

      Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote.
      ABSENT - Councilwoman Schultheis.    

   c.   # 2011-09 - AN ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY
                           PROVIDING FOR THE APPROPRIATION OF $5,000 FOR THE
                           PURCHASE OF FIRE DEPARTMENT EQUIPMENT FROM THE
                           GENERAL CAPITAL - CAPITAL IMPROVEMENT FUND.

      Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to introduce
      Ordinance # 2011-09 on first reading.

      Second reading to take place on July 19, 2011.

      Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;
      ABSENT - Councilwoman Schultheis.   

      d.   # 2011-10 - AN ORDINANCE OF THE TOWNSHIP OF ALLAMUCHY PROVIDING  
                               FOR THE APPROPRIATION OF $10,000 FOR THE PURCHASE OF
                               EQUIPMENT FOR THE STREETS AND ROADS DEPARTMENT FROM
                              THE GENERAL CAPITAL CAPITAL IMPROVEMENT FUND.

      Motion by Councilman Young, seconded by Councilman Sloane, carried to introduce
      Ordinance # 2011-10 on first reading. 

      Second reading to take place on July 19, 2011.

      Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;
      ABSENT - Councilwoman Schultheis.

      e.   # 2011-11 - AN ORDINANCEOF THE TOWNSHIP OF ALLAMUCHY
                              PROVIDING FOR THE APPROPRIATION OF $10,000 FOR
                               IMPROVEMENTS TO ALLAMUCHY TOWNSHIP
                              BUILDINGS AND GROUNDS FROM THE GENERAL CAPITAL
                              CAPITAL IMPROVEMENT FUND.

     Motion by Councilman Young, seconded by Councilman Sloane, carried to introduce
     Ordinance # 2011-11 on first reading.

     Second reading to take place on July 19, 2011.

     Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote.
     ABSENT - Councilwoman Schultheis.
       
 10.  ORDINANCES - SECOND READING:

     a.  # 2011-06 - ORDINANCE DESIGNATING THE POSITION OF PURCHASING
                             AGENT.

        Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to adopt
        Ordinance # 2011-06 on second reading.

        At this time, the meeting was open to the public.

        There were no comments or objections and the public hearing was closed.

        Roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;
        ABSENT - Councilwoman Schultheis.
 
 11.  RESOLUTIONS: 

        a.   Approval of Liquor License Applications (ATTACHMENT 1).
        b.   "BE IT RESOLVED, by the Township Council of the Township of Allamuchy, County
              of Warren, State of New Jersey that the following Tax Sale Certificate is hereby
              cancelled - Block 901 Lot 40.01 - # 2009-02 in the amount of $42,474.16.
        c.   Adoption of the Multi-Jurisdictional Hazard Mitigation Plan (ATTACHMENT 2). 
        d.  Appointment of James Kozimor as Qualified Purchasing Agent (ATTACHMENT 3).
 
        Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on roll
        call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;  ABSENT -
        Councilwoman Schultheis.

 12.  OTHER/NEW BUSINESS:

        a.   Approval of Bingo/Raffle Applications - Friends and Neighbors of Allamuchy, N.J.
              Events to be held 09/07/2011 and 10/27/2011 at the Mountain Villa School and the
              Panther Valley Golf and Country Club.

        Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on

13.   APPROVAL OF BILLS AND ADD-ON LIST (ATTACHMENT 4).

        Motion by Councilman Sloane, seconded by Councilman Ochwat, and approved on
        roll call vote:  AYES - Councilpersons Sloane, Ochwat, Young and Mayor Cote;
        ABSENT - Councilwoman Schultheis.

14.   EXECUTIVE SESSION 7:25 P.M.

        Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to go into                        
        executive session at 7:25 P.M. to discuss potential litigation.  Roll call vote:  AYES -
        Councilpersons Sloane, Ochwat, Young and Mayor Cote; ABSENT - Councilwoman
        Schultheis.

15.   ADJOUNRMENT - 7:40 P.M.

        Motion by Councilman Sloane, seconded by Councilman Ochwat, carried to go out of
        executive session and to adjourn at 7:40 P.M.  Roll call vote:  AYES - Councilpersons
        Sloane, Ochwat, Young and Mayor Cote; ABSENT - Councilwoman Schultheis.
